1. The Basics

Welcome to QuoteMust! QuoteMust is a SaaS platform designed to help creators, marketers, and professionals discover inspiring quotes and generate high-quality, aesthetic social media graphics ("Quote Cards"). These Terms of Service ("Terms") apply to the quotemust.com website, related software, and other QuoteMust-operated services (collectively, the "Service").

These Terms govern the relationship between QuoteMust ("we", "our", or "us") and any user of the Service ("you", "your", or "User"). By using the Service (including searching the quote database, downloading backgrounds, or creating Quote Cards):

  • You agree that you are entering into a legally binding agreement with us.
  • You represent and warrant that you have the full right, power, and authority to agree to these Terms.

If you do not agree to these Terms, please do not use the Service. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.

We reserve the right to change or modify these Terms at any time. If we make material changes, we will notify you via the Service or by email. By continuing to use the Service after any revised Terms become effective, you agree to be bound by the new Terms.

2. Definitions of Content

In these Terms, we refer to several types of digital assets:

  • "Quotes": The text-based database of quotes, authors, and tags available on the Service.
  • "Backgrounds": The aesthetic, AI-generated base images provided by QuoteMust.
  • "Quote Cards": The final graphics generated by you using our Quote Studio, combining Quotes, Backgrounds, and your personal assets.
  • "User Uploads": Any logos, QR codes, or custom branding materials you upload to the Service to be applied to your Quote Cards.

3. The QuoteMust License (Using Our Assets)

Our goal is to empower your content creation. When you download Backgrounds or generate Quote Cards from the Service, we grant you an irrevocable, worldwide, perpetual, non-exclusive, and royalty-free right to download, use, copy, modify, and distribute the Content for both commercial and non-commercial purposes.

You do not need to provide attribution to QuoteMust, though it is appreciated.

Prohibited Uses:

While you have broad commercial rights to use the generated Quote Cards (e.g., in social media marketing, advertising, or printed merchandise), this license is conditional on you not engaging in the following:

  • Systematic Scraping: You cannot use data mining, robots, or similar data gathering methods to extract our 500,000+ Quote database to create a similar or competing text database service.
  • Standalone Resale of Backgrounds: You cannot download our AI Backgrounds in bulk and sell or distribute them on a standalone basis (e.g., uploading them to a competing stock photo website or selling them as raw digital wallpapers).
  • Illegal or Misleading Use: You cannot use the Content in a way that is defamatory, pornographic, hateful, or in breach of any laws. You also cannot use Quotes in a deceptive way (e.g., attributing a quote to the wrong author intentionally to spread misinformation).
  • Watermark Circumvention: If you are on the Free tier, your Quote Cards will include a QuoteMust watermark. You agree not to actively crop out, obscure, or computationally remove this watermark. To remove watermarks legally, you must upgrade to a paid Pro or Creator tier.

4. AI-Generated Content Disclaimer

You acknowledge that the Backgrounds provided on QuoteMust are generated utilizing advanced artificial intelligence (AI) technologies. While QuoteMust provides these assets to you completely royalty-free for commercial use, the global legal landscape regarding the copyrightability of AI-generated art is continually evolving. We make no absolute warranties regarding the copyright immunity of AI-generated Backgrounds in all jurisdictions, and you use them at your own discretion.

5. Your User Uploads (Brand Kits)

To personalize your Quote Cards, the Service allows you to upload custom assets such as logos and QR codes ("User Uploads").

  • You retain 100% ownership of all rights, title, and interest in your User Uploads.
  • By uploading them to the Service, you grant QuoteMust a temporary, secure license solely for the purpose of storing them in your account and rendering them onto your Quote Cards within the Quote Studio.
  • You warrant that you own the intellectual property rights to the logos and QR codes you upload, and that their use does not infringe on any third party.

6. Subscriptions, Billing, and Merchant of Record

Certain features of the Service (such as watermark removal, advanced APIs, and custom branding positioning) require a paid subscription (e.g., Pro or Creator tiers).

  • Merchant of Record: Our order process is conducted by our online reseller and Merchant of Record (e.g., Lemon Squeezy / Paddle). They handle all customer service inquiries related to payment processing, subscriptions, cancellations, and global tax/VAT compliance.
  • Cancellations: You may cancel your subscription at any time through your account dashboard. Your premium access will remain active until the end of your current billing cycle.

7. Acceptable Use of the Service

To ensure the platform remains fast and reliable for everyone, in using the Service, you agree that you will not:

  • Reverse-engineer, decompile, or attempt to derive the source code or rendering logic of the Quote Studio.
  • Bypass any measures we use to restrict access to the Service (such as sharing Pro account credentials with multiple unauthorized users).
  • Use the Service to store or transmit any virus or malicious code.
  • Use the Service for purposes of performance benchmarking or for building a competitive automated image-generation API without explicit written consent.

8. Term and Termination

These Terms take effect the first time you access the Service. If QuoteMust, in its reasonable discretion, determines that you or your use of the Service violates these Terms (such as automated scraping of our database), we reserve the right to suspend or permanently terminate your account and IP access without notice or liability.

9. Reporting Copyright Infringement

QuoteMust respects the intellectual property rights of others. If you believe that a specific quote text, author attribution, or User Upload accessible through the Service infringes upon your copyright, please report it to us immediately by emailing [Your Support Email]. Please include identification of the copyrighted work, the URL on our Service, and your contact information.

10. Indemnification

You agree to indemnify, release, and hold harmless QuoteMust, its operating entity, and affiliates from any losses, expenses, damages, and costs (including reasonable attorneys' fees) resulting from your violation of these Terms, or any claims brought by third parties arising out of your specific use of the Quote Cards (e.g., trademark disputes regarding the custom logos you chose to upload).

11. Warranty and Liability

THE SERVICE, QUOTES, AND BACKGROUNDS ARE PROVIDED "AS IS". WE OFFER NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING THE ACCURACY OF ANY QUOTE, AUTHOR ATTRIBUTION, OR THE FITNESS FOR A PARTICULAR PURPOSE. QUOTEMUST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. IN NO EVENT SHALL QUOTEMUST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE OR GENERATED ASSETS.

12. Severability and Governing Law

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms shall be governed by the laws of [Your Jurisdiction/Country], without regard to its conflict of law provisions.
